Terms and Conditions of Service Use

These Terms and Conditions of Service Use (hereinafter referred to as the “Terms and Conditions”) set out the rules to be followed when using the Little Stars English Learning Application (hereinafter referred to as the “Application”) provided by Future Little Stars Co., Ltd., a company under Starfish Education (Starfish Co., Ltd.) (hereinafter referred to as “we,” “us,” “our,” or the “Company,” as appropriate), and when receiving the services of the Application (hereinafter referred to as the “Services”). These Terms and Conditions constitute a legally binding agreement between Future Little Stars Co., Ltd. and the user (hereinafter referred to as “you,” “your,” or “user,” as appropriate).

By registering as a user of our Application and starting to use the Services, you acknowledge and agree that these Terms and Conditions automatically become a legally binding contract between you and us, in accordance with the law.

Use of the Service

1. Use of the Service
  1. 1.1 In order to start using the Service, you must register an account as a user. During registration, you are required to provide your personal information accurately, including your name (any name), phone number, date of birth for account creation requested by the “Application”.
  2. 1.2 You are responsible for maintaining the security of your account. You will be solely responsible for all activities carried out using your account and User ID, whether performed by you or by another person. We shall not be responsible for any loss or damage arising from another person’s use of your account password due to your negligence, or from your failure to comply with these Terms and Conditions.
  3. 1.3 Once you have successfully completed registration in the Application, you will be able to access and use the available Services within the Application, and you may attend one or more courses that you have selected and subscribed to.
2. Service Fees and Payment
  1. 2.1 From the date of registration in the Application, users can access for 7 days FREE Trial as described on conditions.
  2. 2.2 we do not directly collect or store any payment card information entered through our services and instead rely on third-party payment processors (such as Google or Apple) to handle these payments.
  3. 2.3 Service fees can be paid using the methods specified within the Application.

3. Use of the Service
  1. 3.1 We do not guarantee that our Application or Services will operate continuously for 24 hours without any delays or errors.
  2. 3.2 The Application may undergo maintenance, updates, suspension, or temporary unavailability of Services. While we cannot guarantee the Application and Services will be completely free from interruptions or errors, we will make reasonable efforts to ensure timely maintenance and improvements so that users can use the Application smoothly.
4. Restrictions on Using the Application
  1. 4.1 You are fully responsible for any information you provide in the Application or to us that is false, misleading, infringes upon the rights of others, is illegal, or encourages violations of the law.
  2. 4.2 You must not, without our permission, access, interfere with, or attempt to bypass the systems, connections, or data within the Application in any way that violates the law.
  3. 4.3 You must not introduce viruses, malware, or any other harmful programs into the Application, or perform any actions that could endanger, disrupt, or compromise the systems or security mechanisms of the Application.
  4. 4.4 You must not perform any actions that could cause harm, interference, or damage to the Application, other users, or any affiliated organizations connected to the Application.
  5. 4.5 You must not use the Application or Services to engage in any actions that are illegal or that encourage or promote illegal activities.
  6. 4.6 You must not, as a result of any mistakes or errors on your part, threaten, coerce, hold liable, or demand money or compensation from our Company, its affiliates, directors, officers, employees, or other users of the Services.
  7. 4.7 If you are found to violate these Terms and Conditions or engage in any unlawful activity, we reserve the right to immediately suspend or terminate your access to the Services and take any legal action as necessary.
  8. 4.8 If any of the prohibitions under Section 4 of these Terms and Conditions are violated, and as a result, our Company, its directors, shareholders, employees, or any related individuals or organizations suffer any loss, damage, claim, or expense (including attorney fees), you are required to fully compensate and indemnify the Company and all related parties.
5. Intellectual Property Rights
  1. 5.1 Our Company holds all intellectual property rights and ownership related to the Application, the courses, lectures, and other content provided, except certain songs, through the Application, including the Company’s trademarks, service marks, innovations, product names, logos, slogans, packaging designs, and goodwill associated with the Services and related products. Therefore, no one is allowed to use any part or all of these intellectual property rights without written permission from our Company. Any unauthorized use will be subject to legal action.
  2. 5.2 For clarity, by subscribing to and paying for courses, lectures, or other content through the Application, users do not receive any ownership or intellectual property rights to such content. Users may not, under any circumstances, distribute, sell, copy, retransmit, or otherwise misuse these courses, lectures, or content in ways that could misrepresent ownership without our Company’s permission.
6. Amendments
  1. 6.1 We may periodically update or modify these Terms and Conditions.
  2. 6.2 We are not obligated to provide you with individual notice of such updates. The changes will be reflected in the Application in an appropriate manner.
  3. 6.3 By continuing to use the Services after the updates or modifications have been published on our website or in the Application, you are deemed to have accepted and agreed to the revised Terms and Conditions. Therefore, it is your responsibility to regularly review and read these Terms and Conditions.
7. Limitation of Liability
  1. 7.1 For any damage or loss, our liability to compensate you under these Terms and Conditions shall not exceed the total amount you have paid for the relevant Service.
  2. 7.2 Except as permitted by applicable law, we shall not be liable to you or any third party for any direct or indirect loss, damage, claim, liability, or expense arising from:
    1. (a) Technical failures that prevent access to our Services or your account, delays, or inability to successfully use the Services;
    2. (b) Unusual or unforeseen circumstances beyond the control of the Company;
    3. (c) Payment failures through mobile payment systems or interruptions, delays, errors, or mobile network issues caused by payment service providers or other circumstances;
    4. (d) Any other matters arising from these Terms and Conditions.
  3. 7.3 If applicable law limits, excludes, or prohibits the limitation of liability for certain damages, our liability shall be limited to the extent permitted by law.
8. Governing Law and Dispute Resolution
  1. 8.1 These Terms and Conditions shall be governed by the laws of Myanmar.
  2. 8.2 In the event of any dispute, you must submit a written “Notice of Dispute” containing your name, address, contact information, the subject of the dispute, and any claims or remedies sought.   3. 8.3 Any dispute arising from this agreement shall first be resolved amicably by both parties within 14 days of receiving the Notice of Dispute. If an amicable resolution is not reached, the dispute shall be resolved in accordance with the law by the competent courts of Myanmar.
9. General Provisions
  1. 9.1 These Terms and Conditions, together with our Privacy Policy and other legally required notices, constitute the entire agreement between you and us.
  2. 9.2 If any provision or part of these Terms and Conditions is found to be invalid, unenforceable, or inapplicable for any reason, that provision shall be deemed void, and the remaining provisions shall remain fully effective.
  3. 9.3 Unless explicitly stated, no waiver of any provision of these Terms and Conditions shall be construed as a waiver of any other provision or subsequent rights. The mere failure to exercise any right or remedy under these Terms or by law shall not be deemed a waiver of that right or remedy, nor shall it prevent the Company from exercising it in the future.
  4. 9.4 Our Company shall not be liable for any interruptions, delays, or failures in providing the Services caused by factors beyond our control, including acts of third parties, government authorities, strikes or protests, trade restrictions, natural events, or other unforeseen circumstances. Any obligations under these Terms will be suspended until such events have concluded. During such uncontrollable events, the Company and account holders shall not hold any party responsible for service interruptions or delays.
